A personal injury is a physical or psychological injury, illness or disease that has been caused as a result of someone else’s negligence.

If you’ve suffered an injury within the last three years due to an accident that wasn’t your fault, it’s likely you’re entitled to compensation. You can also claim on behalf of children under age 18 if you are the parent or appointed guardian.

There are no upfront costs for you to pay and no hidden costs either. Keylaw provide free legal advice while we consider whether you have a claim and if your case is taken on, your solicitor will advise on the best way to fund your claim such as on a no win, no fee, basis as well as the cost of your claim. The vast majority of cases are funded by a no win, no fee agreement meaning you won’t be charged legal fees if your claim is unsuccessful. If you win your claim you will be charged a success fee that will be taken from your damages as agreed upfront. All other legal fees will be covered by the defendant should the case be successful.

Every case is different which means that the settlement figure will depend on a number of factors including:

• Loss of earnings
• Expenses incurred
• Care requirements
• Future support

In simple cases where there is compelling evidence of negligence, the claim can be settled very quickly. However, serious injury or fatality may take longer. Once you have spoken to our solicitors and we have all the details available, we can advise on an approximate timescale.

Less than 1% of all cases end up in a trial. Keylaw will always try and settle the claim out of court, keeping the claim process as short as possible. However, if the process of bringing the claim does not result in an immediate settlement you may have to attend court.

Compensation is usually paid within 28 days, with the vast majority being paid within 14 days.

You can act on behalf of another person under the age of 18 or if they’re unable to represent themselves due to injuries or mental state.
